When parents separate or divorce, how they co-parent going forward has a bigger impact on their children's lives than almost any other decision in the case. A co-parenting agreement — whether reached by agreement or court order — is the foundation for that ongoing relationship.

A co-parenting agreement is a written arrangement between separated or divorced parents that governs how they will share responsibility for raising their children. It covers not just the custody schedule but also how the parents will communicate, make decisions, and handle conflict — day in and day out.

In North Carolina, co-parenting arrangements are typically formalized as part of a custody order or separation agreement, making them legally enforceable.

Physical custody schedule — regular weekly schedule, holidays, school breaks, summers

Legal custody — how major decisions about school, healthcare, and activities are made

  • Communication between parents — what method, how quickly each must respond, and what topics require discussion vs. notification only

  • Communication between each parent and the child during the other's time

  • How schedule changes are requested and approved

  • Right of first refusal — whether one parent gets the opportunity to care for the child before a third-party caregiver is used

  • How disputes between parents are resolved before going back to court

  • Relocation — notice requirements and process if one parent wants to move

Not every co-parenting situation involves two parents who communicate easily. When conflict is high, the most important thing a co-parenting agreement can do is reduce the need for communication by being specific enough that most situations are already addressed. The less room for interpretation, the less room for argument.

In high-conflict situations, we also advise clients on communication tools — dedicated co-parenting apps, documentation practices, and limiting contact to written communication — that help protect them legally and reduce day-to-day friction.

When a co-parenting agreement is part of a court order and one parent isn't complying, that's a contempt issue. We can file a motion to enforce the order and seek make-up parenting time, attorney's fees, and other remedies.
